Board of Trustees Regular Meeting

January 2, 2019


The Village of Elmwood Board of Trustees met in Regular Session on Wednesday, January 2, 2019 at the Elmwood Village Hall.  The meeting was called to order at 7:00 p.m.   Chairperson Bruns stated that a current copy of the Nebraska Open Meetings Act was posted; additional meeting documents were available. Roll Call was answered by Kathy Goerlitz, Becky Kicak, and Miki Bruns.  All signed the “Notice of Acknowledgement of Meeting”.  A copy of the proof of publication, as well as the Chairperson and Trustees’ acknowledgement of receipt of notice, are on file.  Notice of the meeting was given in advance thereof by posting in three (3) public places (the Post Office, Village Office, and Elmwood Convenience Store).  Minutes were taken by Connie Carlton, Clerk/Treasurer.


Approval of Minutes:  Motion by Goerlitz with second by Kicak to approve the minutes, as presented, of the December 19, 2018 meeting.  RCV: Yes: Kicak, Bruns, Goerlitz;  No: None.  Motion approved 3-0.  Motion by Kicak with second by Goerlitz to approve the minutes from the December 20, 2018 special meeting as presented.  RCV: Yes: Kicak, Goerlitz, Bruns; No: None. Motion approved 3-0.


Approval of Claims for Payment:  Almquist, Maltzahn, Galloway & Luth $6,825.00 (2017-18 annual audit); Cass County Refuse $65.00 (Dec Refuse Service); Elmwood Public Library $2,000.00 (Jan monthly transfer); JEO Consulting Group $975.00 (Nov-Dec Comp Plan Services); JEO Consulting Group $1,000.00 (2018 Engineering Expense); NE Public Health Environmental Lab $30.00 (Lab testing – water); Nebraska Digging Services $1,825.00 (water main emergency repair); Office Depot $97.80 (office supplies); OPPD $4,129.38 (Nov-Dec Electricity); 12/26/18 Payroll $2,781.77; Register of Deeds $22.00 (misc services); Windstream $141.34 (Nov-Dec telephone).  Motion by Kicak with second by Goerlitz to approve the claims as presented. RCV: Yes: Goerlitz, Kicak, Bruns; No: None.  Motion approved 3-0. 


New Business:   Terry Galloway of Almquist, Maltzahn, Galloway & Luth presented the 2017-2018 Audit findings. The report is available to be read at the Village Office during normal business hours.


Ordinance No. 2019-001 – Master Fee Schedule: An ordinance to establish the amount of certain fees and taxes charged by the Village of Elmwood for various services including, but not limited to: Building permit & infrastructure fees, zoning fees, occupation tax, public records, response to code violations & other incidents, annual fees and licences, returned check fee; municipal utilities including water and sewer for residential users and commercial users (including industrial users) of the Village of Elmwood and to provide the effective date hereof, and ordering the publication of the ordinance in pamphlet form.  Motion by Kicak with second by Goerlitz to adopt Ordinance No. 2019-001 titled the Master Fee Schedule.  RCV: Yes: Goerlitz, Kicak, Bruns. Motion adopted 3-0.


Unfinished Business:  Chairperson Bruns presented David Ernst as candidate to serve out the remainder of Trent Shrader’s 2020 term.  Motion by Kicak with second by Goerlitz to approve David Ernst to the Village Board.  RCV: Yes: Goerlitz, Kicak, Bruns; No: None. Motion approved

3-0.  David Ernst read the Oath of Office as presented.  Motion by Kicak to nominate David Ernst as the Vice-Chairperson to the Board; with second by Bruns.  RCV: Yes: Kicak, Goerlitz, Ernst, Bruns. Motion approved 4-0.


Action on Conditional Use Permit for the Townhomes at 16-10-10 Elmwood-Trail Ridge Addition Lot 1 Block 3 (418 and 420 West C Street), Rutalkn, Inc. as allowed under Section 5.07; R-1 Single-Family Residential District Pg. 45 Sub-Section 5.07.03 Permitted Conditional Uses: Sub-Sections 5.07.0308 Two Family Dwellings. In addition, the Planning Commission and Board of Trustees recommends that the Conditional Use Permit shall be valid indefinitely unless there is a violation of the Elmwood Zoning Regulations or the Elmwood Municipal Code. This conditional use permit is being granted as the Board of Trustees finds this request meets all the requirements under Section 6.05 Standards, including Sections 6.05.01-6.05.11.  Motion by Kicak to approve the conditional use permit for the townhomes at 16-10-10 Elmwood – Trail Ridge Addition Lot 1 Block 3 (418 and 420 West C Street), requested by Rutalkn, Inc as allowed under Section 5.07: R-1 Single-Family Residential District Pg. 45 Sub-Section 5.07.03 Permitted Conditional Uses: Sub-Section Two-Family dwellings; and Section 6.05.01-6.05.11; second by Goerlitz.  RCV: Yes: Ernst, Kicak, Goerlitz, Bruns; No: None. Motion approved 4-0.


REPORTS OF BOARDS, COMMISSIONS, AND COMMITTEES:  Street:  No Report.  Park:  Three bids were received for the gazebo.  Motion by Ernst to not accept Nate Lockman’s proposal to place a vending machine at the park; second by Kicak. RCV: Yes: Goerlitz, Kicak, Ernst, Bruns; No: None. Motion approved 4-0.  Library:  No Report.  Water:  December Water Usage – Pumped 2,780,000; Treated 2,339,000; Wasted 441,000; 2017 Pumped 21,498,000; 2018 Pumped 30,556,000; Increase of 9,058,000. Planning/Zoning: December 27, 2018 meeting minutes were available for reading.


Public Comment Period:  No comment. 


Future Agenda Items:  None noted.


Adjournment: There being no further business, the meeting was adjourned at 8:26 p.m. I, the undersigned Clerk/Treasurer hereby certify the foregoing is a summary of all matters discussed at the January 2, 2019 meeting of the Board of Trustees, and was available to the public within ten working days.
