Board of Trustees Budget Hearing/Regular Board Meeting

 

September 5, 2018

 

 

The Village of Elmwood Board of Trustees met in Regular Session on Wednesday, September 5, 2018 at the Elmwood Village Hall. The meeting was called to order at 7:00 p.m.   Chairperson Anderson stated that a current copy of the Nebraska Open Meetings Act was posted; additional meeting documents were available. Roll Call was answered by Brandon Collins, Julie Anderson, Miki Bruns, and Kathy Goerlitz. Board Member Trent Shrader was absent from the meeting.  All present signed the “Notice of Acknowledgement of Meeting”. A copy of the proof of publication, as well as the Chairperson and Trustees’ acknowledgement of receipt of notice, are on file.  Notice of the Budget Hearing/Board Meeting was given in advance thereof by posting in three (3) public places (the Post Office, Village Office, and Elmwood Convenience Store).  Minutes were taken by Connie Carlton, Clerk/Treasurer.

 

 

New Business: The Budget Hearing was opened at 7:00 p.m.  No comment from the public was heard regarding the 2018-2019 annual budget.  It was noted that a few changes had been made to the original budget.  The Public Hearing portion of the meeting was closed at 7:16 p.m.

RESOLUTION NO. 09052018.1 – A RESOLUTION OF THE CHAIRPERSON AND BOARD OF TRUSTEES OF THE VILLAGE OF ELMWOOD, NEBRASKA ESTABLISHING THE PROPERTY TAX REQUEST FOR FISCAL YEAR 2018-2019.  WHEREAS, Nebraska Revised Statute 77-1601.02 provides that the property tax request for the prior year shall be the property tax request for the current year for purposes of the levy set by the County Board of Equalization unless the Board of Trustees of the Village of Elmwood, Nebraska passes by a majority vote a resolution or ordinance setting the tax request at a different amount; and WHEREAS, a special public hearing was held as required by law to hear and consider comments concerning the property tax request; and WHEREAS, it is in the best interests of the Village of Elmwood, Nebraska that the property tax request for the current year be a different amount than the property tax request for the prior year.  NOW THEREFORE, the Board of Trustees of the Village of Elmwood, Nebraska by a majority vote resolves that:  a. The 2018-2019 property tax request be set at $179,034.62 which would require a tax rate of $0.487461.  b. A copy of this Resolution be certified and forwarded to the County Clerk on or before September 20, 2018 as part of the village budget. PASSED AND APPROVED THIS 5th DAY OF SEPTEMBER, 2018.  Motion by Collins with second by Bruns to adopt Resolution No. 09052018.1 as read. RCV: Yes: Bruns, Collins, Goerlitz, Anderson; No: None; Absent: Shrader.  Motion approved 4-0.

 

 

RESOLUTION NO. 09052018.2 – A RESOLUTION OF THE CHAIRPERSON AND THE VILLAGE BOARD OF TRUSTEES OF THE VILLAGE OF ELMWOOD, NEBRASKA INCREASING THE RESTRICTED FUNDS LID BY 1% FOR FISCAL YEAR 2018-2019.  WHEREAS, pursuant to Neb. Rev. Stat. 13-519, the Village of Elmwood is limited to increasing its total of budgeted restricted funds to no more than the last prior year’s total of budgeted restricted funds plus population growth plus two and one-half percent expressed in dollars; and WHEREAS 13-519 authorizes the Village of Elmwood to exceed the foregoing budget limit for a fiscal year by up to an additional one percent increase in budgeted restricted funds upon the affirmative vote of at least 75% of the governing body; and WHEREAS, the Annual Budget for Fiscal Year 2018-2019 in the Lid Compu-

tation Fiscal Year 2018-2019 supported by the detail relating to restricted revenue accounts, proposes an additional increase in budgeted restricted funds of one percent as provided by

 

statute; and WHEREAS, approval of the additional one percent increase in budgeted restricted

 

funds is prudent fiscal management; does not increase authorized expenditures, and is in the best interests of the Village of Elmwood and its citizens.  NOW THEREFORE, BE IT RESOLVED BY THE VILLAGE OF ELMWOOD BOARD OF TRUSTEES:  THAT upon affirmative vote by more than 75% of the Village Board, the budgeted restricted funds for Fiscal Year 2018-2019 shall be increased by an additional one percent as provided by Neb. Rev. Stat S13-519.  PASSED AND APPROVED THIS 5th DAY OF SEPTEMBER, 2018. Motion by Collins with second by Goerlitz to adopt Resolution No. 09052018.2 as read. RCV: Yes: Bruns, Collins, Goerlitz, Anderson; No: None; Absent: Shrader.  Motion adopted with 80% affirmative vote by the Village Board or 4-0. 

 

 

RESOLUTION NO. 09052018.3 – A RESOLUTION TO ADOPT THE BUDGET FOR FISCAL YEAR 2018-2019.  BE IT RESOLVED by the Chairperson and Board of Trustees of the Village of Elmwood, Cass County, Nebraska:  WHEREAS, a proposed Budget for the Fiscal Year beginning October 1, 2018 through September 30, 2019, was provided to the Village Board on the 5th day of September, 2018. NOW THEREFORE, the Governing Body of the Village of Elmwood, Nebraska, by a majority vote, resolves that: The Budget for the Fiscal Year beginning October 1, 2018 through September 30, 2019 is hereby adopted as the Budget for the Village of Elmwood, Nebraska for said fiscal year.  PASSED AND APPROVED THIS 5th DAY OF SEPTEMBER 2018. Motion by Bruns with second by Collins to adopt Resolution No. 09052018.3 as read.  RCV: Yes: Bruns, Collins, Goerlitz, Anderson; No: None; Absent: Shrader.  Motion adopted 4-0.

 

 

ORDINANCE NO. 2018-019 – AN ORDINANCE TO ADOPT THE BUDGET STATEMENT TO BE TERMED THE ANNUAL APPROPRIATION BILL; TO APPROPRIATE SUMS FOR NECESSASRY EXPENSES AND LIABILITIES; TO PROVIDE FOR AN EFFECTIVE DATE.  BE IT ORDAINED BY THE CHAIRPERSON AND BOARD OF TRUSTEES OF THE VILLAGE OF ELMWOOD, NEBRASKA: SECTION 1. That after complying with all procedures required by law, the budget presented and set forth in the budget statement is hereby approved as the Annual Appropriation Bill for the fiscal year beginning October 1, 2018 through September 1, 2019.  All sums of money contained in the budget statement are hereby appropriated for the necessary expenses and liabilities of the Village of Elmwood, Nebraska. A copy of the budget document shall be forwarded as provided by law to the Auditor of Public Accounts, State Capitol, Lincoln NE and to the County Clerk of Cass County, Nebraska for use by the levying authority.  SECTION 2. This Ordinance shall take effect and be in full force from and after its’ passage, approval, and publication or posting as required by law. PASSED AND APPROVED THIS 5th DAY OF SEPTEMBER, 2018.  Motion by Bruns with second by Goerlitz to adopt Ordinance No. 2018-019 as read. RCV: Yes: Goerlitz, Collins, Bruns, Anderson; No: None; Absent: Shrader. Motion adopted 4-0.

 

 

New Business Continued – Discussion/Action of estimate for tree trimming of the elm tree on main street.  Motion by Bruns with second by Collins to have Christiansen Tree Service remove the elm tree on main street for the sum of $1,150.00. RCV: Yes: Bruns, Collins, Goerlitz, Anderson; No: None; Absent: Shrader.  Motion approved 4-0.  Discussion of the rezoning of property located at 117 North 4th Street.  No action taken, pending attorney opinion re: zoning change.

Motion approved 3-0.

 

 

REPORTS OF BOARDS, COMMISSIONS, AND COMMITTEES: Street: No Report.  Park: Wood chips have been raked back in place after the heavy rains.   Library:  No Report. Water: HOA should be here next week to install water plant updates.  Sewer:  Routine maintenance jetting has been completed.  Planning/Zoning: The Board is still in need of 2-3 new members.

 

 

Public Comment Period: No Public Comment.

 

 

Adjournment:  Motion by Bruns with second by Collins to adjourn the meeting.  There being no further business, the meeting was adjourned at 8:10 p.m.  I, the undersigned Clerk/Treasurer hereby certify the foregoing is a summary of all matters discussed at the September 5, 2018 board meeting/budget hearing by the Board of Trustees, and was available to the public within ten working days. All proceedings were contained in the agenda for at least twenty-four hours prior to said meeting.
